fees

A product fee is paid by an enterprise introducing products in packaging onto the Polish market. The duty to calculate and pay the product fee arises out of failure to meet the obligation to recover or recycle packaging.

Product fees for the calendar year are paid to the account of the relevant province marshal’s office by 15 March of the following year.

When do you need it?

The duty to calculate and pay product fees applies to the following situations:

Failure to comply with the obligation to recover waste packaging arising out of the sum total of all packaging (e.g. paper, plastic, wood, metal)
Failure to comply with the recycling obligation with respect to the sum total of all packaging (e.g. paper, plastic, wood, metal)
Failure to comply with the obligation to recycle packaging waste (e.g. for certain types of packaging, such as paper packaging).

Entities required to calculate and pay product fees are also required to register and submit reports in the online system of BDO (Database on Products, Packaging, and Waste Management).

Do I need it?

Do you introduce onto the market products in packaging from plastics, aluminium, steel, wood, paperboard or glass?

The duty to pay product fees applies to enterprise that:

Introduce packaging onto the market.
Export packaging.
Export products in packaging.
Conduct intra-Community supply of products in packaging.
Introduce products in packaging onto the market.
Introduce certain products into Poland (e.g. oils and tires).
Sell plastic shopping bags.

This duty does not apply to enterprise that export or conduct intra-Community supplies of products or products in packaging which were previously introduced into Poland via import or intra-Community acquisition.

An enterprise commencing activity involving production, import or intra-Community acquisition of products in packaging or products listed above is required to notify the province marshal accordingly, without summons, within 30 days after launching activity.
