I. Introduction

These Terms & Conditions for Electronic Delivery of Services implement the provisions of the Electronic Delivery of Services Act of 18 July 2002 (Journal of Laws Dz.U. 2020 item 344, as amended).

In implementing the Electronic Delivery of Services Act, KR Group sp. z o.o. with its registered office in Warsaw, as the Service Provider, introduces these Terms & Conditions, specifying in particular:

  • Type and scope of services delivered electronically
  • Conditions for delivery of such services, including technical requirements and prohibitions on delivery of unlawful content
  • Conditions for conclusion and termination of contracts for electronic delivery of services
  • Complaint procedure
  • Conditions for transmission of commercial information.

Consent to comply with these Terms & Conditions when launching the service accessible on the website https://www.krgroup.eu/ is deemed to mean acceptance of these conditions.

II. Defininitions
  • Electronic Delivery of Services Act—Electronic Delivery of Services Act of 18 July 2002 (Journal of Laws Dz.U. 2020 item 344, as amended)
  • Telecommunications Law—Telecommunication Law (act of 16 July 2004, Journal of Laws Dz.U. 2019 item 2460, )
  • ICT system—a set of interacting IT devices and software for processing, storage, transmission and collection of data via telecommunications networks using an end-user device appropriate to the given type of network, within the meaning of the Telecommunications Law
  • Services delivered electronically—performance of activities consisting of transmission and receipt of data using IT systems at the individual request of the Service Recipient, without the simultaneous physical presence of the parties, where such data are transmitted via telecommunications networks within the meaning of the Telecommunications Law
  • Means of electronic communications—technical solutions, including ICT devices and programming tools interacting with them, enabling individual agreement at a distance using transmission of data between ICT systems, in particular email
  • Service Provider (us)—KR Group sp. z o.o. with its registered office in Warsaw, ul. Skaryszewska 7, 03-802 Warsaw, Poland, entered in the commercial register of the National Court Register by the Warsaw District Court, 14th Commercial Division of the National Court Register, under KRS no. 0000290003, tax no. (NIP) 1070008585.
  • Service Recipient (you)—the user of the Service Provider’s services, a party to a contract on delivery of services who is a natural person, a legal person, or an organizational unit without legal personality, who undertakes to comply with these Terms & Conditions.
III. Types and scope of services delivered electronically

We deliver by electronic means the newsletter service, or other services based on separate, individual contracts.

The newsletter service consists of electronic delivery of messages containing the latest information about our activity and topics related to the services we provide, in particular accounting, taxes, and HR issues. Emails may also contain commercial and promotional information about the activity of our firm and our offers, products and services.

Commercial and promotional information is regarded as requested if you consent to receive such information by subscribing for the newsletter service and providing for this purpose an email address identifying you. Provision of an email address is deemed to mean:

  • Consent to receive commercial information from us by means of electronic communications in accordance with Art. 10 of the Electronic Delivery of Services Act
  • Consent to use of end-user telecommunications devices and automated calling systems for purposes of direct marketing in accordance with Art. 172 of the Telecommunications Law.

The newsletter service is provided free of charge, for an indefinite period. You may unsubscribe from the newsletter service and emails from us at any time by notifying us accordingly in any form, e.g. by writing to the address of our registered office, telephone or email through the contact details provided on our site, or by clicking on the link in any email received from us as part of the newsletter service. This is deemed to mean termination of the contract for electronic delivery of services.

IV. Conditions for electronic delivery of newsletter service
  • We undertake to deliver electronic services in accordance with these Terms & Conditions.
  • We shall not be liable for losses caused by use of the services in a manner contrary to applicable law or fair practice, or otherwise inconsistent with these Terms & Conditions.
  • In specific instances affecting the security or stability of the ICT system, we reserve the right to temporarily cease or restrict the delivery of services without prior notice and to conduct maintenance work to restore the security and stability of the ICT system.
  • You undertake to use the newsletter service in a lawful manner respecting the personal interests, copyright and intellectual property rights of the Service Provider and third parties.
  • You undertake not to deliver through or to our ICT systems content of an unlawful or defamatory nature, and, in using the services, not to take actions contrary to these Terms & Conditions or which could disrupt the delivery of services.
  • You undertake truthful data.
V. Complaints
  • Complaints related to the electronic delivery of services may be submitted in writing to the address of our registered office or by email to office@krgroup.pl
  • We encourage you to provide information and circumstances concerning the subject of the complaint, such as the type of irregularity and the date, a description of your demand, and contact details.
  • We will resolve a complaint promptly, but no later than 14 days from submission.
  • If we are not in a position to resolve a complaint within that time, we will inform the complainant of the reasons for the delay and the anticipated period for resolution of the complaint.
VI. Minimum technical requirements

To use the newsletter service, it is necessary to have a device with internet access and email, such as a computer, laptop, tablet or smartphone.

We recommend using:

  • An internet connection with a speed of 2 Mb/s or greater, but no less than 1 Mb/s
  • Free software, enabling opening and reading of .pdf files, if the message we send contains such files—application can be downloaded at www.adobe.com
  • An email program such as Outlook or Mozilla Thunderbird, or
  • A web browser such as Firefox, Chrome or Edge to access email.

Use of a web browser may require the use of cookies and Java scripts, depending on your email provider and which browser you use.

We also recommend:

  • Turning on a firewall
  • Current updating of your operating system
  • Installing an antivirus program and regularly updating the base of viruses and malware.
VII. Concluding provisions
  • Matters not addressed by these Terms & Conditions shall be governed by applicable provisions of law.
  • We reserve the right to amend these Terms & Conditions for legitimate reasons, in particular due to changes in legal regulations affecting compliance with these Terms & Conditions.
  • You are required to comply with the new Terms & Conditions if we comply with the requirements set forth in Art. 384 and 3841 of the Civil Code, i.e. if we properly notify you of the changes and you do not terminate the contract for electronic delivery of services within 14 calendar days from the date of the notification.
  • If a change in these Terms & Conditions would result in the introduction of any fees, you, as a consumer, have a right to withdraw from the contract for electronic delivery of services.
