Fiscal representation

As a non-EU business entity, your status as a taxpayer will vary among EU tax authorities and may be treated differently for tax purposes. Supplies of goods or services, local purchases in the EU, import or moving stock within the EU might be deemed taxable transactions.

In Poland, Romania, and Hungary, non-EU companies will not be allowed to register for VAT and settle monthly/quarterly returns themselves.

Do I need it?

Non-EU entities fall under the obligation of appointing a fiscal representative. At KR Group, we have years of experience in supporting clients in VAT obligations, guaranteeing the fulfilment of all tax authority obligations.

Companies from the UK and Norway are exempt from this obligation, but they can voluntarily opt for it to mitigate their tax risk and cut administrative costs. 

Who is a fiscal rep?

A fiscal representative (or fiscal agent) is jointly and severally liable for the client’s VAT obligations. The fiscal representative will be held accountable for the client’s misreporting on VAT, missed deadlines, and unpaid taxes. In practice, if the VAT due is not paid by the taxpayer, the fiscal representative is legally obligated to pay it.

Appointment of a fiscal representative is done through a written agreement, which must be submitted to the local tax authorities.
