Several years ago, Poland, along with other European Union countries, implemented regulations under the DAC6 directive aimed at increasing transparency in transactions and enabling tax authorities to detect aggressive tax planning activities. The responsibility of fulfilling these duties may be assigned to someone within the company, but the legislator provided for the possibility of entrusting MDR responsibilities to an external company which will help ensure compliance.

Failure to comply with MDR-related obligations, including an untimely submission of information and lack of procedure, can result in a fine of up to several million. Additionally, members of the board of directors may be held liable (banned from conducting certain activities or from holding a position such as board member).
